Members of the Academy nominate for their own - actors nominate actors - cinematographers nominate cinematogrphers - etc. Those who have received a minimum amount of nominations (I don't know what the number is) go on to the second round and have the chance to get nominated by anyone in the academy. At least that's what someone told me.

Each of the nominees within a catergory are voted for by academy members within that branch - film editors nominate file editors, etc.
Every one can vote for best picture and best foreign film.

Hollywood is very political and of course members are going to vote their favorites or by their associations to the nominees. Is it fair? That's unfortunately, how voting happens sometimes. Remember high school - the best person wasn't elected President - it was always the one with the most friends.

I like to think some folks truly take voting seriously and try to separate the true outstanding achievements each year, but we're often left to wonder.

Hollywood is always on the cutting edge of diversity - gay films, films about disabilities, about a true human struggle against the odds are always favored.

The sad thing to me is that they don't always give the Oscar to the most worthy.

It is fun to catch all the major films prior to the awards and do "will win" and "should win" score cards.

Pffft. Fair. Hollywood knows no meaning of the word "fair." I'm surprised Scorsese hasn't told the industry to shove the Oscars where the sun doesn't shine. Poor man. To think, his grave could say, "Many great successes, shunned by his own praisers." *shakes head* Hopefully that won't be so. Someday, Scorsese's day will come.

The Academy picks what they think is Oscar worthy for the year...

I don't think its fair, thats why we have the People's Choice Awards.

A bunch of men sit around a table and pick the films that were the most controvercial or had the best actors. It is 100% biased, but that's how it has been since the tradition started.
