Extremism at its best. They are governed by Federal Law and the laws of the country in which they serve. Homicide may/might be legal if self defense can be proven and using the excuse we're at war is never an adequate defense for shooting helpless civilians (MURDER). Rape is never justifiable under any circumstances.

You sound very disrespectful of the armed forces who fight and die for your freedom on a daily basis. Poop happens and it's often a line of poop that gets into the media and the circus begins. There are cutural differences in defining both homicide and rape and our soldiers don't know of them and don't care. Is meerely patting a woman on the back a rape...in some cultures quite possibley yes. Is breaking someones arm a murder...in some cultures yes. Your question is interesting but remember that these words have different meanings elsewhere. HERE THEY ARE BOTH APPALLING ACTS of DISRESPECT.

Rape and homicide are not lawful in the United States, regardless of whether or not someone is in the Army. If someone in the army kills another person as a result of the war, that would not be considered homicide because the other person is trying to kill them. It doesn't mean the army person could walk into a civilian's home and kill them, saying it was an act of war. That would be considered homicide. The key phrase there is a civilian.

American soldiers get tried and prosecuted for these crimes just like American citizens do. But its a little harder to catch people doing it in the middle of a war. When you can do something and not be caught you are more likely to do it.

Violence is a sine qua non of war, but war does not excuse rape and unjustified killing (homicide).

The perpetrators of this crime should be brought to justice.

In the USA, as soon as you say "I'm doing it for my country" anything is legal. Well, as long as it's against someone who is not american. I mean, you could strap an american flag to your arm, walk around in Iraq throwing grenades into school yards and say, "I'm freeing my country from terrorists!" And the US government will defend you. It's sick isn't it?
