I had been employed for a local hotel for almost a year,I was promised a higher postion (managment over housekeeping} well the assistant gm new a girl that needed a job and hired her,she was a house keeper for only 3 months and she was the one that was promoted to the management postion,well i became her assistant and she did not like that from the start,well she ended up hiring one of her friends and needless to say the manager told her friend and all the other hispanics to complain on me,so they did and i got put on a 10 day probation,then a week later i became sick and called in,i had a doctors note and when i went up there my name was not on the schedule and my time time was gone. Well I filed unemployment and filed a claim with th labor bored. Yes i do have people that heard them talking about there plan to get rid of me. So should i go through with unemployment and the claim? I can tell you alot more but i am limited on how many words to write. Please help?

THAT IS WRONG . AND IT IS NOT FAIR TO YOU AFTER BEING THERE AS LONG AS YOU HAVE. I WOULD GET ADVICE FROM THE EEOC, I WOULD NOT LET THEM GET AWAY WITH THAT. HAVE YOU PLAYED BY THE RULE? SO THEY WOULD NOT HAVE ANY THING TO COME BACK ON YOU WITH BECAUSE THEY HAD KNOW BUSY PUTTING YOU ON PROBATION. WHEN YOU HAD A DOCTOR EXCUSE. IF YOU DO NOT CALL IN ALL THE TIME.DID THEY PUT THAT IN WRITING .IF THEY PROMISE YOU SOMETHING YOU NEED IT IN WRITING. BECAUSE THIS WILL HAPPEN AGAIN .WITH ANY JOB I WOULD KEEP MY JOB. BUT SEE IF YOU HAVE A CASE.......... AND THE MEAN TIME LOOK FOR SOMETHING ELSE.

start with gathering facts not hearsay.

When and who promised you the promotion - what conditions, if any were attached?

spell check your documents -

Have you spoken with HR?

you may have a case however there are key points you need to research
Does your employer have a written policy on recruiting?
What is the background of the person promoted over you? Education, past employment etc.
What was the basis of you being placed on probation? What were the terms?
You mention "all the other" Hispanics - are you a different race? Do you feel that you were discriminated against?

Of course you can file, but think about it in the long run. Is the fight worth it or are you talented and hard working enough to find employment quickly somewhere else? If you have that manager abilities, then you may very well have a great job before the claim is settled.

dont let them oush you around file a lawsuit and everything. File anything you can and nail these people fast! What they did was wrong and they deserve to loose their jobs not you.

If you have proof, go ahead with the claim. Make sure that it is proof that they cannot explain away.

If the story is as you say...then do everything to can to get justice....Don't let people get away with being unjust.
