A friend and I want to start an online poker site like PokerStars but getting a gaming license can cost $10k+, so we thought a play money site would work, but would I still need a gambing license if no money was involved?

You wouldn't need a gaming license if no money is exchanging hands. And you could still put up paid banner ads.

Depending on your municipality, you may or may not need a business license.

The problem is that there already exists a huge saturation of Poker on the Internet. Why would somebody come to your site instead of one of the hundreds (thousands?) of others already out there? It would have to be a pretty amazing site to gather any users, and would have to have quite a lot of users before any banner advertising will pay enough to cover your expenses. And the more amazing the site is, the higher the expenses of development would be.
