In general, it is in most states. The laws do date back some 150 years or so through...and are not much enforced or even looked up by anyone. So, basically, it's 'legal'.

Consenting and no one calls the cops, how can it be illegal? However, you run the risk of that person turning on you can saying they did not consent, so be careful who you trust.
