My husband is still paying child support on two adult daughters. These wages are being garnished out of his paycheck. Now there is a possibility that his niece is his daughter. If the paternity test comes back positive, what will the state do to us? Will it demand back child support in full? Order us to pay back brother? Take over child support payments? Any help is appreciated. I am absolutely freaking out as I have been diabled since 2001 and my husband has not been able to afford my medicines and doctor visits, so I suffer already!

First no he will not have to pay back support on the child and he will not have to pay anything back either..........All he will have to do is when the support order is brought to court then he will have to pay support..........And how old are his other daughters because unless he owes back support he does not pay for them after they turn 21 years old...........Just take it easy and when it comes to court im not sure what you should do..........The only reason that the payments of support are so high is because the courts have to add your disability wages to his.........but that is not that big of a deal...........Just look at some legal books and if you need more money there are some websites where you can get personal government grants which is free money to pay for your needs.........if you go to www.top2005scams.com/grants.html? it will give you three or four different sites you can go on to get the grants.........Good Luck................

For one, the two adult children that are getting the child should stop at the age of 18. And now for the really good question?????????? This child that you say "could" be his niece??? This means that he would have had to sleep with either his sister or your sister. I would say this man has got a very bad problem to say the least!!!!!! You did not say as to whether or not this child "niece" came before or after you two got together. But if she came into the picture after you two got together, that man would be gone. If she turns out to be his daughter, then yes he will pay child support on that child as well. And further more he could be forced into paying the support for this child from day one. He just needs to learn that he needs to KEEP HIS PANTS ON!!!!!!!!!

If this last child came after you two were together, he has cheated on you. And further more, if the mother of this child is his sister, he is one sick man. But if your sister.. well he just plain cheated on you!!!

If his niece is in need of child support and he is proved to be the father, he will have to pay child support.

A better question is why is this man so out of control? What kind of life is he living? Other than relying on him for your upkeep, what are you doing with him? You've been disabled for 5 years and you're STILL not able to work? What are you doing wrong?

Contact a local attorney.

Most of the time child support is not retroactive, or retroactive for short period of time, like 2 years.

What is going on with this family?

In short... yes they can demand back child support. What I would do is contact a GOOD lawyer.

There is such thing as medical assistance. I would suggest using it. I don't believe however they can go back and charge him.
