I have filed now and get the papers soon, he doesnt want to sign. He said I have to wait until, he returns from basic and AIT, that would extend it longer. I was hoping for the 30-90days. Do I have to wait to serve him or can he be served in basic?

You should wait. You can serve him while he's in basic, but it'll be a hassel to do so. And since you've already said he's not willing to sign them, it won't do you any good anyways. Besides, it's better to do this sort of thing face to face. If you were adult enough to get married, you're adult enough to hand him the divorce papers yourself.

if he already knows about this, then no. he's just putting it off. you can serve him in basic, but who wants to be served in basic training? that really puts you in the worst state of mind to have to complete all that you have to do in basic. if you can, i would wait. you could still get on with your life, the only thing on hold is the paper work.
