Where is the property located? Is it a community property state, such as Texas? Keep in mind that the property may still need to be Deeded to the surviving spouse, otherwise you could end up with a dead person in Title. Also, was there a Will? If not, remember that the Decedent's heirs-at-law still have their interest in the property. Was there a Right of Survivorship? See, there are alot of questions to answer before you can get a definite.
