No, because the Supremos left the matter to be resolved between congress and the executive. The ruling is more accurately reported that the supremos said the matter is not spelled out clear enough, so you guys get to work and spell it out clearly. It was a ruling demanding clarification and definition of the nuance of the situation.
Good opinions on both sides of the bench though.....a real good read with much insight into the minds of the supremos' and the nature of the separation of powers. Then again, Bush can always use the precedent set by Jackson regarding the Seminoles, and ignore the Supremos as saying they overstepped their authority by simply hearing the case.

Bush is taking reasonable steps in a time of war to counter the exact threats and failings the 9/11 Commission revealed. IDIOTS are now demanding he stop. Perhaps they, unlike Bush, cannot learn from the mistakes of the past.
Or, perhaps they really do want to see America harmed just for their own political gain.
During WWII, measures taken to detect and thwart spies inside the US were far more extreme and invasive than anything Bush is doing. Back then, Americans were in charge of America, we were all on the same team, and we all did our part to help defeat those enemies who might be sitting next to us at the coffee shop reading a newspaper and overhearing conversations. Even the press was severely restricted in what it could report. That is one reason we won in that conflict.
Internal enemies of the US do all they can to prevent us from thwarting our enemies today.

It is about time the system finally works right. The supreme court stepped in and brought bush back down to earth. He may be the president but he isn't in control of everything. I never thought the whole check and balance thing actually worked until I saw that on that news. I am glad to see something in the government actually works like it was ment to.

It was a political ruling that ignored Stare Decisis. Bush did what FDR did, held Military Tribunals, read the dissent of the ruling if you choose.

They still have the death penalty in some American States,
Can you not get him to visit one that has the death penalty,
