If both the biological father and mother signed Gauridanship to the maternal grandparents... Who has to file for child support?? Mother or grandparents?? and if grandparents have to seek support do both Mother and Father have to pay support??

My brother-in-law is currently going through this and she(ex) is threatening him with child support. He does provide the things that the baby needs but refuses to give his ex any cash money without a court order.

i'm not sure about other states but in VA the grandparents have to. My mom works for child support enforcement and she said if they both signed over 'legal' gaurdianship then everything should be ok. But they have to get child support from both parents not just from the dad or mom.

Both parents have to pay Child support ot the Grandparents, but the Grandparents would have to file against you/father and depending on how many children you have it goes by a % on how much is taken off your gross wages...

I believe the answer is yes to both. If the Grandparents are raising the child, both the mother and father owe support, and it is up to the grandparents to file for it.

That sounds like a real mess.

you didn't ask, but this comes up a lot. Know ahead of time that child support and visitation are totally separate. so if you get behind, the grandparents can't say, well you can't see your kid until you get caught up in you support payments. this happens between parents all the time, and people think they go hand in hand. they don't.

If the grandparents have custody of the child/ren then they would have to file for support. And yes, both parents have to pay.

that is observed as an action to Compel. it really is a felony action for help without filing for divorce or separation. new child help organizations do this even as married human beings have not yet filed for divorce. both father and mother should be financially to blame for the youngsters. until eventually there is an order lower than a divorce case, both father and mother have equivalent rights in regards to the youngsters (ie custody/placement).

Yes, mother and father would both have to pay support.
Whoever has custody and needs the support should file.
