Other than usurping the Legislative and Executive power, it's incredibly short sighted. If the bad guys aren't abiding to the Geneva Convention, it begs the question about Haditha if you assume the Marine actually killed those people then the argument could be made since the bad guys aren't wearing a uniform as prescribed by Geneva that the Marines mistook them for bad guys and should be released immediately.
(Even though there has been no finding of wrong doing by the Marines in Haditha)

I guess if we have to treat them according to Geneva we could just execute them summarily on the battlefield. That would solve the liberals problem with GITMO and we would have to worry about them killing our guys after they were captured.

It was predictable.

The supreme court is becoming like the Senate. You pretty much know ahead of time which way everyone's going to vote.
