If the age of consent is 16, it doesn't matter if she told him she was 14. It's still statutory rape.

According to what I know and what I have researched, this kid can be charged because he was over the AOC. They are within 4 years of age, but it depends on the state and how much pull the parents have in the matter. The best case scenario is that she isn't going to charge him with anything, and the worst case is that she could drag this into court, he could wind up serving jail time, etc. Another thing, how long ago did this happen? Most states have a time limit in which to report crimes, and if she hasn't done it already, it may not stick.

in every state, if one is 18 and the other is under age 18, its considered under the laws with have sex with a minor. rape under the law is when there is no consent and force was involved. even if consented, if one is under age you have big trouble. only one state has at the age of 13 and girl can marry. since they are both under federal legal age of 18. it can be fought not to mention that she lied about here age. if anyone is charged with rape, depending on the state. it can be years and your on file for life as a preditor.

This is a real moral gray area. They are both juveniles who could just as well be in high school together. On top of this they were dating. Nobody was forced to do anything. This young man should not have to do jail, nor almost worse, be on a registered sex offenders list. That is way too harsh. Hopefully they'll just give him a verbal reprimand and community service.

The offence is a strict liability one. This means that there is NO excuse for having sex with someone under 16 - none that the courts of law will recognise. i.e. if you kill someone, the courts may excuse you under 'self defence'. there is no similar excuse for strict liability sex with minors.
He is so so screwed. There is NO excuse whatsoever. No matter if she lied. No matter if she looks like shes 91. If she's under 16, your boyfriend is screwed. There is no escape.
But he is only 17, not 51, so the court may look leniently on him. and even if she is 14, if she looks 19 year old, the jury may just buy his story.

10 to 20 big time..depends on the state and the judge...If you run with this guy then you are also taking on a lifetime of grief. If he has to register as a sex offender then you are going to be watched for the rest of your life.. Think about what you are doing with your life. This guy is not smart..

Ok for one thing, your best friend is a dumbass for lying...her ex was a dumbass for having sex with a 14 year old....
Now, as for your question....even if he is faced with the charges, he most likely would be charged in juvenile court. If that's that the case he'll have to complete a sex offender course, serve community service, and probably be on probation. If they charge him as an adult, most likely he'll serve a minimal sentence in county jail, probation, again, the sex offender courses, and possibly have to register.
My advice....stop hanging out with dumbasses, be true to yourself, and don't overly concern yourself with this guy....

It all depends on the state, but he will have to register with the states sex offender registry, One of the charges may be risk of injury to a minor. Maybe sexual assult... you should look them up on your states website.
