So does this make him a War criminal...

For this crime & the long list of his other war crimes.
Nothing can stick to our teflon pres. This & every other
atroscity will just slip right off him. Disturbing.

I don't think so. You can only be a war criminal if you do something attrocious like kill people. Making a mistake on classifying prisoners as enemy combatants rather than regular prisoners when there is no precedence is not THAT attrocious.

Although, I would like the president to face more heat than he has on this-- if his administration was so sure that these men were guilty (which they have said time and time again that these men were), then why would they go to all this trouble to delay their trials and to try them in military tribunals? Wouldn't it have been easier just to treat them as ordinary criminals as a default? Then their rights wouldn't have been infringed....but I guess that would make too much sense:)

No, unfortunately. This is mainly due to the ex post facto clause (after the fact). Basically, an individual cannot be charged of a crime after a new law or decision is passed that did not exist beforehand.

That only re-itterates the fact that he should be considered a war criminal. Have you heard of "The Asses of Evil?" Just a clue, GW is one of them.
