I'd like to know who I could contact to see about a tree that is on private property, that the limbs keep falling off. The limbs has not cause any personel damage as of yet. I live where this tree is at, and I have a parking space right where the tree is at. The owner keeps telling me that, my car insurance will cover any damage the limbs might cause.Is'nt there any code for property owner's when it comes to trees, being cut down or kept trimmed?

Tell the owner that your car insurance won't cover all the damage caused by his dangerous tree. You'll have to pay the deductible, usually $250 to $500. The next thing that will happen is that your insurance company will collect for damages from either him or his homeowners/property insurance. Then you'll be reimbursed for the deductible. His insurance company will either cancel him or raise his rates. Things would be much better for everyone, including the tree owner, if he would take care of the dangerous situation. I hate to think what would happen to him if his tree injured or killed a person!

Try your library for a good book on Law and your rights as a neighbor. Barnes and Noble or Boarders book stores carry those kinds of law books.[ Both stores have tables and chairs where you can sit and look through the books to see if they have the information you need, before you buy].
Also you can take him to Small Claims court which doesn't entail needing a lawyer. Take pictures of his tree and how it overhangs where your car is to show the judge proof of how the limbs fall. If your neighbor loses' , as he most surely will, he has to pay court costs as well as damages to you. Your neighbor is responsible for maintaining his trees so that they don't cause damage to the property of others who live next to him. If you can't get through to him, a Judge can. You might also call your local Mayors office to find out about local ordinances.

The limbs are falling down because the tree "needs" to be trim ASAP for the safe of the tree and people too.

From what I understand, any part of a tree that extends on to your property, is your responsibility. So you have the right to cut or trim, or whatever, to what is on your property. I would cut those
limbs as close to the property line as you can and then seal it

They are responsible for any damage. If it hangs on you property you can trim them. Go to the court house and get a plot of the land to make sure they aren't yours. Then find out about any oridances. Good luck.

You might contact the City Offices and ask them what rights you have. There are different regulations depending on where you live. Just call your City Information number in the front of the phone book and they will send you to the correct department.

everytime a tree limb falls toss in on the tree owners cars let his insurance pick that up!

You need to call Code Enforcement in your area. If it's not listed in the phone book, call the non emergency police number and ask them to direct you to the office you should contact about it.

legally any limb that hangs over on your property can be cut by you... and there is nothing the neighbor can do or say about it.
