Probably in US you can be fired for breathing. In New Zealand large numbers of workers belong to unions to protect their rights. You can't get fired immediately for that.

First of all - I don't know if you realize that the story starts with the subject being "somebody" to 'she' and then 'I' in the 2nd to last sentence. Anyway... from what I know about employer procedure - this one occurence could merit a write-up or reprimand but not to the extreme of firing - unless you already had other documented reprimands. But really maybe the point is that you didn't seem to mind subjecting others to something so foul and disgusting - maybe you do not belong in customer service. You should've made an attempt to get clean pants on.

You can get fired for anything. Technically they can fire you because it is raining outside. They do not have to have justification for firing. Although, if you are fired for reasons other than your own doing (insubordination, absenteeism, theft, etc) you can collect unemployment comp until you can find a new job. But if you using the friend theory, you might want to double check your story because at the end you said that "I got fired at the end of the day" Sorry for you bad luck::-(

JC Penney's, like most businesses, can fire a person for almost no reason at all.
Unless your 'friend' can prove that incontinence is part of her listed disability, then she's not covered under protection for any sort of discrimination policy.

It's not legal to fire someone for messing their pants. It is legal to fire someone for not going home and changing when they've messed their pants. It's called insubordination, also probably violates the dress code pretty badly.

Your friend should have complied with the instructions given to her by her manager. In most states, your friend would be considered an "at will" employee. In other words, the could fire her at any time for almost any reason that wasn't specifically prohibited by law such as race, religion or gender.

I believe they can for making them look bad, tarnishing their reputation. Also, the employee disobeyed a command from their superior. Furthermore, presentation is a big part of the company, and if the employee was representing the company in a bad way by looking like that, they could get fired.

If they told you to go home and change and you didn't, I think they probably can. I would have went home. Department stores have to keep things clean and nice smelling. Not nasty.

yes they can. it is company policy that all employees who deal with people must look their best, and since she sharted and left a stain on her pants, she did not look her best and violated company policy, which got her fired.
