Late last year, Congress approved legislation declaring that U.S. interrogators cannot torture prisoners or otherwise subject them to cruel, inhuman, and degrading treatment.

But President Bush's signing statement said the president, as commander in chief, can "waive the torture ban" if "he" decides that harsh interrogation techniques will assist in preventing terrorist attacks.

The Commander-in-Sheik has outright admitted to countless violations of federal law, with warrantless wiretapping in direct violation of FISA. What the NSA is doing is explicitly prohibited by federal law, that's been in place for almost 20 years. And Congress told Bush Sr, Cheney and Rumsfeld (who were all personally involved during FISA hearings in the 80s) that such activities were prohibited, so there's no question of it being misinterpreted.

And the Supreme Court has had to slap down the administration twice so far for illegal activities in Guantanamo. And these are activities that are explicitly prohibited in the text of the constitution, so there is no real question of interpretation.

Similarly, Congress has passed laws, including suspending Habeas Corpus, which are also in direct conflict with the text of the Constitution. Not just Supreme Court interpretation -- the actual literal text.

So, either they haven't read the Constitution, or they know they're overstepping their legal authority and they don't care.

No. Only iffy thing is the wiretaps, and I'm ok with it. If it helps them find the terrorists and stop them, good.
