A class action lawsuit was filed on June 20, 2006 in U.S. District Court challenging HB 1059, the Georgia sex offender legislation passed in 2006 by the General Assembly. The named Defendants include Governor Sonny Perdue, Attorney General Thurbert Baker, and Polk County law enforcement officials.

Lawyers from the Southern Center for Human Rights (SCHR) and the American Civil Liberties Union of Georgia are seeking a Temporary Restraining Order to stop state and local entities from enforcing the 1,000 feet restrictions from school bus stops on and after its July 1, 2006 effective date.

This afternoon, U.S. District Judge Clarence Cooper ruled that the Temporary Restraining Order applies to everyone on the registry.

Yes, that's great news. NOT. But at least the neighbors know he's there, unlike most sex offenders, or sex offenders in the making-------

The problem with laws like the one they're suing to stop is that they surpass common sense in the names of "safety" and "zero tolerance", heeding the siren's call of "Won't someone think of the children?!?!?"
There used to be common sense. But today? Today you can be considered a "sex offender" for such crimes as pissing on the sidewalk (Michigan) and having sex with someone your own age (about 25 states). Yes, that's right. Under the Georgia law that has been put under a Temporary Restraining Order, a high school Junior could be forbidden to attend high school (which is within 1000 feet of a school bus stop) because he and his classmate Susie got caught fooling around under the bleachers [statutory rape].
All this does is say until it's settled whether or not the state can do this legally, they can't force people to move. Nothing to get worked up about.

There's just another step down the path to complete idiocy. Once again rights have been granted to a criminal of the most despicable kind and not to the innocent children.

If I'm 17yr old and have sexual relations with my 15yr old boy friend is that bad news. Should I be placed on the sex offender list.

sounds downright scary that there are people in this world who are that stupid to protect sex offenders so strongly.
