Your husband can request a custody hearing whether your in the mental hospital or at home if he feels your not doing what the children need. If you are to the point that you know you need to commit yourself to a mental hospital, then do what you need to for you because in the end that will be what is best for your kids. The kids need their Mom to be well and functional.

Health records are confidential. He will have to go through the Courts in the divorce, ask them to get a copy, the mental facility will then send it to the Judge who will decide if it is relevant to the divorce case. Obviously it very well may be relevant, but he can't just GET the records on his own.

I am sorry that you are going threw a difficult time at this point of your life.It is hard to prove a mother unfit first off,but if your soon to be ex husband is anything like my ex,they will try anything to prove that you are unstable to raise your children.Of course nine times out of ten it is done out of spite,because most men are not wanting to really raise them,they are not wanting to pay the child support,and this comment is not for all men either,there are some good ones out there,but the good ones wouldn't be doing what your soon to be ex is trying to do,by ruining your reputation as being a mother to your children.Yes,he might be able to try this,but if i am not mistaken,there is a law out now about hippa,which i think doesn't allow any info without your permission,you should talk to your Doctor about this!I don't know if you have already admitted yourself or thinking of doing so,but if you haven't,try to seek other measures,such as support from family and Friends or if you need to talk email me,I've been there and would be more than glad to help if possible.You need to vent your problems,so that you can work threw them,trust me i had to go threw alot with no one to even care enough to talk to me.So don't hesitate to ask for help.Ok?I hope to hear from you and you take care and i wish you nothing but the best and my prayers will be with you and take care of the Children,your their mother!Do and be all you can be,show him that you are stronger than he gives you credit for!Good Luck!

YESSSSSSSSSSSSS!!! Don't do it yet! Otherwise he will have proof that your mental state is not stable enough to take care of the children, and the courts always put the welfare of the children FIRST. On a divorce, parties try to use whatever they have on hand to get the most. Don't let this happen to you.

Be calm and wait until after the divorce. Best of luck

Absolutely. Do you need to take this drastic of a measure? It's only because he IS your husband that this info could be used against you.
