in most states the age of consent is 18 some states 16... meaning that both parties have to be of age or over in order to engage in a sex act if one of the persons is underage and lies about it and says she's or he's older then she/he is it's still considered statutory rape...now he might not get that long of jail time if convicted but he will be put on a sex offenders list for the next 20 years

and as for the person who said that no 12 to 13 year old girl look older then what she is I knew this girl when she was 12 was asked at a restaurant/bar if she wanted something to drink and I'm not talking a glass of coke and she looked older then 12 and this was 16 years ago

Why is the girl lying about her age? A 13 year old girl should not be hanging out with a 19 year old guy let alone be having sex. IF she wants to hang out with this guy or any older guy in the future don't lie about your age. It will only complicate things as you probably all ready know. And yes, he should be convicted because it is his responsibility.

The law isn't going to care if she lied, they're only going to care about the fact that she's 13 and that the guy had sex with an underage girl.

Yes, he should be. Not only that, it's the law. It's up to the guy to find out the real age of the girl. This guy, if he gets caught will be in big legal trouble.

He could be easily, but I think the punishment would be minor, seeing the way she looks and her lying. It might just be probation.
Problem is, he may be listed on a sexual abuser list, and marked for life, which would ruin him for getting a job, and holding a responsible position.
It pays to be very careful.

When in doubt check the chick's birth certificate. Otherwise lay off. In jail you can get sodomized by the guys.
