My stepkids mom owes us back child support, she now says she is going to get disability. Will she still be ordered to pay child support, or will we get any help from her? Their dad and I work full time to make ends meet, but make to much to to get any assistance. Are we screwed or will we get help from her through disability??

they should take it out of the disability check. Start looking into it. You know you have to make that stuff happen.

If a parent goes on disability and they are ordered to pay support the government cuts you a check for the child. I know because my ex brother in law is disabled and keeps popping out kids and gets another check for every one he has. As soon as she is approved if she gets approved you will get a backdated check from the time she applied.

Although states have their own rules when it comes to child support there is a federal child support web site that you can look at. ALL states have to follow the federal guidelines.

If I am not mistaken, when the "step mother" receives disability, her child support will be deducted from her checks, If this is a court ordered child support order.

No. The kids have to live with her to get anything. it's sad but if she gets disalility the kids wont get any thing.And she wont be made to pay any child supp. either. I have a brother and sister-in-law going through the same thing right now with their little girls daddy.But it also depends on what state u live in..

i believe they will dock the check...how were the payments set up? through the court or directly from her? you need to follow up and make sure the divorce settlement is adhered to

Yes .It will come out of her check,whenever she starts getting it.
