Todd has moved all of his assets into his wife's name so he won't lose anything to the Moore family should he lose the first Civil suit.

The division of real estate, among other assets, only becomes an issue in a separation/divorce. What each spouse must prove, in order to have a claim on property bought by the other during the marriage, is that the property was used for a family purpose. For example: This house is rented out and your wife split the rent money with her sister, your wife could spend it on groceries or gas for the family car. In that case, she uses the property as a resource to make income for the family, and you have a claim. In your case, you have also contributed to the property with the *expectation of family income* from it ... therefore, you may also have a claim, but it could be reduced to only the exact amount you contributed when a divorce takes place. However, depending on where you live, if she does not involve the family in any way with the running of the property, or does not use the income from the property for a family purpose, you may have to prove your contribution was a loan to your wife. The problem I have with your question is that you don't say who will be living in the house. If its a tenant, you may be okay, but if her sister plans on living there and not paying rent, the issue could be a little grey. The whole crux of the matter is whether income from the property would be used for a Family Purpose ... YOUR family. And also, it depends on the laws in your jurisdiction.

supposedly, todd transfered full ownership of their house in kitchener ontario to his wife. supposedly this is illegal, but im no law expert and dont know why.
My personal opinion: Steve moore should go through with this lawsuit in vancouver,(he deserves something) then just move on, but we all know hes gonna be a dik about it and ***** and complain for years to come...
