Yes. Contract or no there's too many ethical issues that can come up. Theft of materials as mentioned is one. Theft of customers is another. Being a competitor is definitely reason for being fired. You know the one place and could undercut their price to gain unfair advantage. Sometimes it comes down to choosing.

This is called "Conflict of Interest"
If he signed a statement forbidding this, he has violated the business rules. Immediate dismissal.
If he did not sign such a statement, and it comes to light, he could still be dismissed. In this case, he may need legal assistance if wants to appeal it.
The worst scenario I can think of, is for him to take one of the companies leads, customers, and steer that customer to his own personal business, undercutting his employer, with no effort or expenditure, such as advertising on his part to find that customer. That is stealing IMHO.
I'd bet the ranch this is being done. Do you not see anything wrong in this?

Pretty much yes.
In most states an employer can fire you for no reason at all. The color of your shirt. The cologne you wore that morning.
Being loyal to your employer is considered to be a good thing. Competing with your employer is considered to be a bad thing. Certainly a fireable offense....

yes he can be fired. activities outside the workplace which affect the employer can be grounds for misconduct. the employer has a right to expect their employees not to compete with them. how can they be sure he isn't stealing customers from them?

all depends on each corporation's policies.
at wal-mart, if you work there, you cannot be employed by ANY other retailer.
at UPS, if you work there, you CAN get a job at FedEx of post office...they don't care.
it's up to the companies that your friend works for. if i were him, i wouldn't tell either place and then they wouldn't know about it.

Rest assured he can be fired for this. Some people I know of steal the materials from their emlplyer in this industry.
