My son's girlfriend who lives with us received a supeona for collection of a very old citi bank account (2000) that had been charged off by citi. when she had the money four years ago, she tried to pay it but they refused saying it had been charged off. now this--with tons of interest and fees added on by the collection agency. she has a job now, but is leaving in aug.to go back to school. really , no money. what do you think.

The seven years is almost up, don't waste the money. It's not a subpoena, just a shakedown letter. It may not actually get removed from her credit report after seven years, but it shouldn't be taken into account by new creditors. It was charged off, so they're out the money and she's out her credit rating.

Anyone can send a subpoena. In order to be valid, is usually has to be signed off by the court (usually a commissioner).

Contact Citibank and try to arrange a settlement. Your credit is already pretty much screwed so the collection agency cannot bargain with you that way. Worse come to worse, remember, we have no debtors prisons. The worst that they can do is sue you and then they have to hire the attorneys and pay court costs. It might not be worth it.

This collection agency purchased the debt from Citibank for pennies. They are trying to make money, plain and simple. If they can get her to make even one $25.00 payment, they have recovered their investment. DO NOT PAY THEM. The original account was with Citibank, and Citibank has charged off or dismissed the debt. Ignore this collection agency and advise your future daughter in law to be more careful in the future. Good Luck!

There is this new thing now with collection companies going after charged off accounts. This isn't strictly illegal. I don't know what state you live in so I can't tell you what your statute of limitations is. Usually its like 7 years. Tell your son's girlfriend to NOT ADMIT SHE OWES THE DEBT to anyone contacting her (like saying, I tried to pay this 4 years ago!) because if the statute of limitations has run out, ADMITTING YOU OWE IT REVIVES IT. So basically, I would just ignore it if I knew it was past the statute of limitations, or I knew it had been charged off. If they keep harassing her, tell her to report them to the state attorney general for illegal collection practices.

If there is no date on the "subpeona" and it is not from a city or county agency then it is not a subpeona. This is a ploy to get payment by the collection company. She should see if it is on her credit report and dispute it if it is. Next year will be the 7 year mark for it anyway.

She needs to contact Citibank and make arrangements to pay off her debts. And no one is going to say . Nooo dont pay me we have already written that 10 thousand dollars off.

toss it in the garbage...collection agencies use all kinds of nearly fraud to try and sucker you into paying...
