When i did, manage too get to court it was thrown out because i had wrong forms, noone will tell me what forms i do need or, how too start again. His defence is that he does not know me I have proof of our relationship ect.

My ex was very forcefull, and during my divorce from my then current husband, he took over all dealings claiming he was, a lawyer, property was sold, and 40.000 was to be devided, between me and my husband, my then husband has recieved his monies, while mine was supposedly put into a spanish bank account, which i was shown, proof of my my ex and, given umpteen excuses why he couldnt acess it, ect. now i can not trace the bank account. I have the so called details, to no avail. cant get legal aid, no soliciter wants case. he is amajor fraud and took money and advantage of me i am vunreble due to ill health
he has lied about even knowing me, if he had nothing to hide why? I am not the only person he has ripped off. does anyone think im on a hiding to nothing??

If what you say is true then you obviously need GOOD legal advice. I cannot believe there are no solicitors willing to take on this case - unless your evidence is patchy - are they advising you that you DO NOT HAVE A CASE? Or refusing to take the case? Perhaps they don't want you wasting your money on a pointless exercise.

Get your evidence in order. Look at it hard and take away all thoughts that you CANNOT prove. Then look at it again through the eyes of an outsider and try and see what they would think. EVIDENCE is the be all and end all of any court case!

You don't say how he obtained this money from you. If it was in a joint bank account or he was a secondary card holder on a credit card account, then you've already provided him with authorisation to take this money and you have no recourse unless you can prove that this spending was carried out in malice, but even then you would need to take a civil action against him.

Try putting some more information on how he obtained it, if it's deception, as in forging your signature then your bank/credit card company as well as the Police have a duty to investigate it.

Please provide some more information, then people can advise you better... there are generally a few lawyers/solicitors floating arond on here too with good advice which is free!

Go to your local Citizens advice bureau they can help you and point you in the right direction, you will also probably need to get legal advice from a solicitor.

You obviously need a good solicitor and legal aid if you have no money

mayb you could visit the citezens advice bereau, they will let you know all your legal option, tell you what you need to do, and what you need to have, im sure they will be able to help, just go in and ask, they deal with things like this all the time, they will help you, good luck!
