I have the check showing "Loan for closing costs" and the names of the coworker and spouse in the memo section. They made one small payment towards the total. My accountant sent a letter but they refused delivery. One other thing, the spouse is in the military service at a nearby base. Can I call his commander? His name is also on the check.

send them a certified letter asking for the $, give them 30 days to respond, then file in small claims court. chances are they will not show up which means you will win, then you have to get a writ of execution to enforce the judgement-which means you should try to find out where this person works or banks-then you can garnish the wages, but if they quit their job or switch banks you have to chase them a little. Happy collecting.

Do you have a proof that he borrow money from you? If you do then take him to you local small claim court. If you don't have any proof then you have to confont him and nicely ask for your money back. Ask him to sign the paper promising that we will pay you in the monthly installment. If he misses the payment they you can take him to small claim court.

You are beyond getting the money back. The only thing you can do is make it cost him as much as he borrowed. IE(does he have a car or a house) use your imagination.
