Call the Mississippi employment commission. Mississippi law governs the employer regardless of where they are from. If you don't get to keep it (as in, get paid for it), then maybe you can take the paid vacation and quit at the end of it. Whatever you do, don't quit job #1 until you have job #2 in your hands.

What most often happens, if you do have the time coming, is that you will give notice but the employer will decide to let you go right away, paying you your own vacation pay as a sort of severance package.

Check your employee handbook. Generally, though, most policies call for the time to be used or lost upon termination/resignation of employment.

maybe, but your vacation time is based the assumption that you will work the full year. if you leave half way through, it may be prorated.

Yes, I believe they are, probably would have been better if you got laid off and a package though.
