A 7 yr paving project is in it's third yr, but the paving is delayed by 2 yrs while we still have to pay the special assasment. I am wondering if we have to continue paying this fee if theproject is not following the schedule that was submitted at the outset.

I don't know. Ask your Condo Association President what's going on and be sure you attend the next meeting so you can bring your issue up for full discussion. A lot of others are probably wondering the same thing. I don't think it's a good idea to just stop anything. If you do, you might end up being charged late fees or penalties. Also, check that big binder that you got when you bought the place.

You need the support of other owners to prevent your money from being wasted. I bought a condo under the assumption my complex had levied and was in the process of refacing the entire complex, but I have recently learned my HOA is so broke that was never the proposed plan. I cannot sue the Realtors, only take the owner who sold me my unit to small claims court for their Realtor misleading me. All in all, our complex is in such bad shape our proposed assessment of $6,000 from 3 years ago will be in the ballpark of $13,000 today. The owners voted the last assessment down because they had paid $2500 the year prior to that proposal that was basically stolen by a HOA management company before the work ever started. Because the owners were not on top of the project the current owners will be paying the most.

Sounds like some money may have been misappropriated or that maybe they'll say the price of "petroleum" makes it too high to do the paving now. However I would get tenants together and ask to see the books on this and see where the money is, you should have that right. I would contact a lawyer and have him listen, which he should do for free.
