If your getting a bj, there is still likelihood, of transmission. If the person who has HIV,has gums that bleed and you might have a slight cut on you penis, that would be an open passage for the disease to go through.
Remember, teeth cut. even if the person gives the best bj, all it takes is just a slight tear on the skin.

First of all, there is no such thing as Safe Sex. But there has never been a recorded case of oral transmission. However, you may want make sure there are no breaks or cuts or tears on the skin of your penis to be "safe" (relatively safe). Anytime you have sex (oral or otherwise) your always taking risks, so be extra careful.

The answer, in general, is yes.

It is certainly not the most likely way, but you can get it because the semen is coming into contact with a mucas membrane, your mouth, and the virus can travel to the bloodstream from there.

Yes, because even if the guy doesn't ejaculate, he is still leaking trace amounts of semen when he is aroused - bodily fluids that carry the HIV virus.
