The lein was placed on the house from the builder for 44,000. The house is 10 months old and the seller claims he does not owe this money. I have had to cancel several things including moving truck and hired help. Do I have any legal recorse?

This is odd because the Title Insurance company should have known about any lien on the house and informed you when you signed the loan papers. Anyway, it seems the seller wasn't truthful with you. Any recourse? Get a lawyer and find out.

Unfortunately, you do not. I have had this happen before, the night before closing. I walked away from that house. The next house I did not make any arrangements until after all of the i's were dotted & the t's were crossed.

Contact a real estate lawyer for your next purchase. It really does not cost that much. I assume you had a title search done & this was when the lien was brought to your attention?

You can either get your down payment back, if seller is not going to resolve the problem, or if the title company is trying to resolve it then you can wait. I just got my new to me house passed escrow, I had to wait 9 months due to 15 owners who all had leins. If the house hadn,t been such a GREAT BUY I would have got my down payment back and looked further.

This is why you buy title insurance. You now have a claim against title that they need to defend you from. Call them.
