Has the person already been served with the summons and complaint? If so, here is what you could do. He/she is subject to the jurisdiction of the court whether he moves or not after the service. Then if he does not show up for court, you should get a default judgment if you specify an amount of damages. Once that judgment is final and the appeal time period has run, you can take it to the state the person lives (if he moves out of state) and file it with a court of proper jurisdiction in that state to attempt to collect it.

Hire an attorney. Have him/her draw up a letter and send it into the court and to the ones with your property. You will also get a copy of this letter for your personal files. If you, the petitioner,is not allowed anywhere near them to retrieve what is your property, then the police may get involved and will ask the ones you filed against, responders, if another party on your behalf can retrieve it for you. Also go talk with the magistrate office. Maybe they can be of some assistance. And possibly get you into court a lot faster. In Va. that's how it works.

the reply is, as with many stuff, it relies upon on the nature of the criminal entity with which your mom is contracting. Is there a company? In that, is there a constrained company with a registered workplace and company huge type as registered at agencies abode? if so, it will be on the bottom of any bill or the headed paper. in spite of this, it will be an organization - a partnership of two or extra people paying for and promoting as a partnership - lower back, they'd have a registered address. Or it made only be a paying for and promoting call "Joe Bloggs t/a Bloggs developers". if so, the fellow doing the pastime and the 'company are one and an same' The reaction for your letter might want to confirm even if there's a company, and in the experience that they have insurers or no longer. If there is any doubt, sue both. make optimistic (if in any respect obtainable) you provide the declare varieties in my opinion so there will be no 'lost in the positioned up' claims being made at a later level. The declare is for the cost of rectification/restoration. Get a separate quote from a respected tradesman to do the pastime and that grants you the declare quantity. Take a good number of images of the wear. i anticipate you mum does no longer favor the bloke decrease back who did the wear in the first position. and he or she does no longer ought to. The small claims jurisdiction is from £a million to £5,000. it really is a no-prices regime. that's strictly one in all those declare the gadget is designed to handle.

I believe that you can file the claim against them and they have to respond/appear. If they don't, a judgement will be filed against them for the amount of the property. I'm not sure how you go about collecting it, though. Sorry.

google small claims court FAQ in your state.

You state that you have filed the paperwork and have set the process in motion.

Until the court makes a decision, the other party has possession of the article in question, and honestly even if the court decides in your favor, you will only get a monetary judgement, not your item back.

Call the police. It doesn't look like you will win in small claims anyway since small claims rarely handles claims for property. Ask the small claims clerk what you can do. Check with legal aid.
