In South Carolina what would happen if a 16 year old with a permit got pulled over when the guardian was not..

in the car but a 18 year old with his liscence was? Keep in mind that the mother is sick, and the 16 yearold was driving becasue the 18 yearold wasn't feeling well also. Oh and this is the first offense.

i live in sc and my uncle is a cop. he says they lose their liscense until they are 18...
