My mom had surgery several years ago and just recently found out that her right kidney is now dead and has to be removed because of a medical clip that was accidentally placed on the ureter of her kidney.

It depends on the operation your mother had and why.

It is important to read carefully through the consent forms your mom signed before the op These should be on record at the hospital. Sometimes the forms say something to the effect that the doctors will not be held liable for any complications arising from the 'aforementioned operation'. That is why it depends heavily on what the surgery was for and what operation it was. Also look carefully at what possible complications were explained to your mom before the op. If these include what has happened now to your mom, it is not medical negligence.

Consult a lawyer immediately and get all records of the op and consent forms from the hospital concerned,

Check her other kidney to see if the surgent left a watch or some money in there. Your mom sounds like a gold mine!

That is definitely malpractice and not only is the doctor liable, but the hospital where it as performed.
I hope your Mom recovers after her next upcoming surgery.

I think you should see a lawyer, if that is something you can prove then sue.
