you can file any suit you want to but whether you will win or not is a different story....most banks now check your credit history as part of the qualification/hiring process so i assume it to be legal

no, because if you applied at a business that deals with you having to handle money. they want to make sure your not having financial problems. sometimes that can lead to the employee being desperate and stealing from their employee to pay their bills.
