The convictions were not drug or violence related, and it has been over 10 years. If you dont have to disclose it, and the company runs a background check, can they terminate you?

When the question is asked, it must be answered honestly. It is during the inverview that you can offer your explanation. Also, if you want, you can attach an explanation to the application. However, no matter how many years, you are obligated to tell the truth or be subject to termination anytime by the company when it is discovered. Your honesty is much more important than any felony record. Be honest and truthful.

If "you don't have to disclose it" at the time the application was submitted and it was not a question posed at that time then I would say no. However you most likely will not get the position with the company if a background check is done prior to hiring. If the company didn't do background checks when you were hired but now does it could effect your employment status. If it was asked when the application was submitted then yes, unless you had the conviction exonerated, (check with your local court house on how to go about having this done for your specific case). Honesty is always the best policy. Don't be afraid to admit your past errors in judgment; it is a healing process and there is always an employer that will hire you with or with out felony convictions. I would check the situation out with a local free legal service to be sure you have the proper information for the city/state which you live and work in.

My suggestion on that is when you are filling out the application most ask if you have been convicted of a felony within the past 7 years. Be sure to read that part of the application. If you are concerned that they will terminate you if they find something beyond that time period then my suggestion is to write something on that part of the application that says will explain upon interview. Depends on the state and the felony. In my state if it is drug-related or over 7 years ago, then no. But in my birth state, that answer is yes you do have to say. Your state should have a website or you can check in the phone book to find someone you can ask.

Also as a rule it is on the application what you are allowed to leave out, I'm not sure but that may even be a federal government rule.

Yes, you must answer in the affirmative. However, use the comments space to explain what happened and that it was 10 years ago. If you lie on your application, it is grounds for dismissal. Further, right now most employers do run background checks, especially if the job is above that of entry level.

All felony offenses must be put on employment applications even if it was 30 years ago. Yes they can and will fire you if they find out and you didn't put it down. Be straight and upfront with them. Tell them when and why you got it. We are all only human and some people did stupid things when they were younger. Anyone can change if they want too.

yes to all of the above it sucks but its true. If you have been a good girl you can have it expunged then never worry about it again. your local court house has the paper work it does have a fee usually... about 29 dollars here in dauphin county PA. but you may be able to present it your self. read the instructions carefully and consult the law library read all statutes to completion that may be referanced in the form.

Some applications specify wether they want it in the last 10 years...if it says have you ever been co.......in the past 10 years, you can say no, if it says have you ever been convited of a felony, and doesn't specify a time period, put yes!

Yup. Crimes (other than traffic offenses) don't disappear unless you expunge them. It's a crime to make false statements on an employment application. Best to be honest because you never know how extensive your employer's background search will be.

If they run a criminal background check it will show show up on the report, that would be a legitimate reason for not hiring you
