You need to check with your city and state laws to see exactly how long you should wait or if you even have to. I know that in Texas they have to honor the check or you can take them to small claims court (as long as it is less that $5,000, i think). However, you can not get blood from a turnup, they say. But in the long run, the money is owed to you and they must pay some how. But the first place to check is with the unemployment agency. They might be able to direct you in the right place for information.

By 'wait' you mean how long? A week, perhaps you can wait. Longer than a month, I'd get some advice from a legal friend (since paying those legal fees could soak up your entire payroll check!) and go to a small claims court. Who knows? You could end up on Judge Judy!

You need to file a claim with your state's department of labor. It varies from state to state, but you are owed that money. You will have to file a "Claim for Unpaid Wages" (or something along that lines).
In addition, I would file a claim at the Better Business Bureau. It rates companies and gives information to others who inquire about them.

they have by law, a 14 day grace period to give you your check....there is nothing you can do until the 15th day. if you still don't have it, you can get an attorney to write a letter for you for about $50. also, your ex-employer is responsible for any fees your bank may have charged you, if any.

IF IT'S POSSABLE CASH IT AT THE BANK FROM WHERE THE ACCOUNT IS . IF YOU CAN'T DO THAT THEN TAKE THE CHECK TO THE LOCAL LABOR BOARD.
