Bush's "Security and Prosperity Pact" (SPP) would combine the Countries within NAFTA (Canada, US, Mexico) into one super Country with it's own Constitution which would supercede the US Constitution and Bill of Rights, similar to what was done with the EU. Existing Borders would be erased. Since NAFTA is already approved by Congress, and our courts say treaty law supercedes US law, can the NAFTA board implement Bush's SPP without approval of Congress?

No, he cannot. Any treaty must be approved by the Senate. And any change to this country's Constitution must be ratified by the people.

This ain't gonna happen.

Is this even a real issue, or is it some bogeyman story?

Frankly it's not a bad idea but I'd include all of Central America and if possible So America too. Supposedly, Congress has authority to ratify treaties so all Bush can do is present the idea to them for ratification...if that happens than we'll be AU (Americas Union). I wouldn't put it past Bush's administration to find some underhanded way to get this through without going through Congress. He'll cite terrorism as a good reason and do an executive order allowing the treaty; of course the Department of Justice will have an obligation to challenge the order in the Courts; than we'll see where it goes.

According to the Constitution, Congress must approve all treaties.

But I wouldnt put it past Bush to try. He seems to think he doesnt need Congress approval for anything else.
