Were any of the bottlecaps bought during the marriage using marital funds? If they were bought with money that was Bert's before the marriage or if Bert bought all of them before the marriage, they probably continue to be Bert's. If marital funds were used, or if Ernie was ever allowed to claim any ownership of the bottlecaps, they are marital property.

Yes, if it isn't in the prenup, then everything else is common property and you have to split it.
But you may get away with a monetary exchange. Just pay Ernie cash for his half of the Berts Bottlecaps.
