I took my 2001 Nissan Pathfinder to a mechanic to have a new engine put it because of excessive smoking. The vehicle still smoked so I took it back for a warrantied repair. They had my vehicle for 6 weeks, lent it out to have drugs dealt in it. I got it back when the Police had seized it, after the driver had smashed said officers car. When I finally got it back it still smoked... as it still does today.

If the car was being used witout your authorization...there should be an additional charge against the person driving it at the time of the accident! You can recoupe those damages thru restitution no law suit necessary. If you want to sue for breach of contract...you need to file suit. If you want to get a judgement in excess of 5k (in NY) you can not file small claims. My suggestion take what you can get in small claims so you dont have to pay the lawyers!

For those of you who doubt the validity of this story, I have to admit, I get clients with outrageous problems like this every day... Your most cautionary remedy would be to contact your county Bar Association to refer you an attorney specializing in consumer and civil matters. Upon reviewing your case, they may refer you to your local magistrate, where you will need to file a complaint and attend a hearing. If they do not find in your favor, then an attorney would step in if you have a viable basis for appeal.

Small claims court is the only way to settle this one - providing your story was true.
I would keep my day job however. your story is completely absurd and ty for the points.

ur question is not clear...
but I think u can claim for the remedies, as ur mechanic have not fullfilled his agreement with u, that is regarding the repairing of ur car...
not only that u can also claim damages for the illegal use of ur car and the mental agony u got from it...
