I took my 2001 Nissan Pathfinder to a mechanic to have a new engine put it because of excessive smoking. The vehicle still smoked so I took it back for a warrantied repair. They had my vehicle for 6 weeks, lent it out to have drugs dealt in it. I got it back when the Police had seized it, after the driver had smashed said officers car. When I finally got it back it still smoked... as it still does today.

You have 2 options. Small claims court. You do it your self no lawyer most states have a $5000 max so if you only want $3000 you're fine.
However it sounds like you may need not only the money for the repair but if your truck was damaged in the accident you need to add that to the cost so you should find a lawyer and get it all.
If it is like you say no work was done at all and should be an easy case either way you go.

First-you get out the phone book. Under State of California, look up the phone number of the Bureau of Automotive Repairs. Call the toll free number, and they will send you a very short form to fill out, sometimes they may just take the info over the phone. Tell them exactly what is going on, or what happened.
This is a very serious organization. They get things done FAST.
You have absolutely nothing to loose, and everything to gain. Do it.

My friend, Get yourself a GOOD attorney, he can advise you on what you need to do as well as what can and cannot be done, Don't worry about trying to get any copies of anything, he will let you know what he needs, or try to get them himself voluntarily or through a court order. you just follow his advice to a "T". If he is a good attorney, he will do just that. also let your insurance agent know what has happened and let them know of your intentions. your attorney will communicate with your insurance as deemed necessary. Also a phone call to Nissan Motor Company corporate offices should be done. You already have the proof that your vehicle was loaned out and used in drug dealing...........a police officer. be sure that you get his name and badge number. I can assure you that corporate level will take action on this against the dealership.

First off, I think you should contact the B.B.B., then file a complaint with motor vehicles. A reputable attorney can assist you in legalaties of the matter, but don't stop there, ruin his and his companies name also. I would also seu for damages, time without your vehicle, damages to your vehicle, and grief you went through dealing with such a loser.

if you took it to a dealership then get a lawyer get copies of the police report, and make a video of engine smoking, get copies of repair bills along with copies of diagnosis. get the vin number off engine parts and photograph your vin plate. have the lawyer contact nissan dealership directly and threaten to sue for emotional loss, financial lost, call the better business bureau. make a big stink and you'll get out on top.

Two things you should do:
1) Report them to the Better Business Bureau.

2) File a Small Claim at your nearest court.

...gather all your receipts as well.

GO JIMBO also contact the states attornys office.With a cop as a witness or possible codeffendant I can't see how you could lose,And the mechanic should loose his licence(buissiness)

First and foremost... get an attorney. It's over $1000, so it will be in criminal or civil court in most localities, not small claims court. This is why you need an attorney.

watch who your mechanic is from here on out. ask around before you give someone the job.
