If not, how do they figure their charges?

It has been my experience in Texas that estate lawyers only work on a retainer basis and not on a contigency basis (%, as you are suggesting).

But anything is possible. If it was by contigency, most attorneys will ask for a third, or 35%. I would negotiate for less.
