It's determined by population...it is in Article One, Section 2 of the Constitution. It had the 3/5 clause...which allowed slaves to be counted as 3/5 of a person...disgusting, I know...but unfortunately those were the times.

It is by the Census, taken every 10 years, on years evenly divisible by 10. 1900, 1020, 1930, etc. Then each state gets its congressional districts by the number of persons they have living in the state.
