the company should pay but will they - it shows up on the drivers driving record ultimately the driver is responsible . if you know for sure is illegal don't do it - you could loose your job over it but that better than some one loosing their life or causing an accident.

If you were on the job and representing the company, the company should be the one to be sued. If you are working on your own behalf and contracted to drive the tow truck, you are responsible for your own work. Who pays the 941? (social security) Does it come out of your check? If so....the tow company is liable for your activity while at work.

you should turn the ticket over to the company from where you got the vehicle. you are only borrowing it and not the owner, therefore the set up of the truck is not YOUR responsibility.
if the company refuses to pay, then take them to small claims court.

Your company should pay for it. It's their fault. The only time you should have to pay is if it is something that is your fault. Like speeding or not wearing a sealtbelt.
