Obviously, it's both. The Constitution protects freedom of expression, but there is nothing in the Constitution about a flag. Therefore the right of self expression, including desecration of the flag, is a higher law than laws prohibiting flag desecration. Or in other words, the Constitution does not prohibit flag desecration; on the contrary, the Constitution protects it.
One problem with flag "desecration" is defining it. I have seen beach towels and bathing suits and underwear that show the US flag. Why isn't it desecration to use the flag as a carpet or towel or clothing?

The flag is desecrated every day by ignorant people who do not understand the proper way to display and care for the flag. The flag should not be used in advertising or put on t-shirts, it should be lowered at dusk unless lit up, should be destroyed by burning when worn or torn. The worst is people who put cloth flags on their car antennae and it gets ruined by the rain and winds and they drive around with a rag on their car.
Is all this in the amendment?
It's just a flag the most treasured symbol of this country should be the Constitution of the United States. But really it's the dollar.
How many flag burnings have there been in the last ten years? 1 ? 2? For this we need an amendment?

The flag is a symbol of fredom it is our countrys
symbol! It should not be burned or spat upon! Our founding fathers fought for that symbol! The symbol
of freedom! And if you dont believe in that symbol if
you mock ,burn or spit on it. Than you should get out!!!!

To me The Flag represents America and all it stands for. It represents ALL the soldiers and Militarys that fought ,died and were wounded for my Freedoms. It represents the family's of the military that were left without their Loved one for me and mine that we can live in Freedom. I think and feel that as an AMERICAN to burn or step on Our flag is a disgrace to me,My Country and all that have sacrificed for it! Can we not have something Sacred in Our Country. They have just about took GOD from her, Can we please keep and love Our Flag, The Flag of the UNITED STATES OF AMERICA.. Land of the Free,Home of the Brave! Don't burn it around me!!!

is burning the flag a nice thing to do???....
no, but the country the you hold dear to your heart is so great because you have the right to do whatever it is you choose...... it's the price of freedom.... you don't have to agree with it.... or even like it.....but it is what it is....
worry about what you can control and everything else just let go... because you will never be happy with everything that other people do!!!!!

I don't understand why anyone would take offence to the burning of the U.S. flag . I say its freedom of speach . As for you though your not looking for any answer other than the one that you have in your head.

it is the symbol of this country and for some one to just burn it i think is attacking every thing this country stand for .so yeah i think it a desecration.

I agree with you. I think people who burn the flag are trying to make others angry and get attention. I don't think it really has to do with protest.
