Why is Andrea Yates (who killed her 5 children) only being charged for 3 of the 5 deaths? I don't get it.
I also read it is common amongst multiple murders to only be charged for some of them, and not all of them.
Hello? Please explain.

The prosecutors hold some of the victims in reserve in case the defendant is not found guilty at trial of the murders with which she has been charged. If that happens, they can bring two more charges of murder against her and try again for a conviction. It's a way of having a second chance of having her sent to prison.

I know it is ridiculous. If she didn't get the death penalty she should at least get 5 life sentences. I've heard the legal explanation but I don't think it makes sense or is fair to the other children that were murdered in cold blood. Also I can't believe she has the nerve to request a retrial.

I think they do it to cut down charges on people who are charged with multiple deaths because in all actuality you can only die once. Although it seems like the two children did not matter but it is a law tactic.

Redundancy. They can only execute you or put you away for life once
