A friend with no bad criminal background has been indicted on charges of trafficking a controlled substance within a 1000 yards of a school. He plead innocent and has court next month. In the meantime his attorney is going to try to reach a plea agreement with the prosecutor. Any ideas of what to expect? The charges are a felony punishable 1-5 years in prison.

I expect your friend will get no jail time because he plead "innocent" and has not gotten to have a trial. But, if there is a punishment, he might be able to be sentenced under the youthful offenders program in your state if he is under 19 years old. He could be given probation, or a 5 yr (or any part of) suspended sentence, or be sent to a 6 week prison 'boot camp' program, or be given community service work. Jail time is doubtful, but he will probably be on a long probationary period. Please tell him I said, "Good Luck and Stay Out of Trouble !"

Most likely he will be able to get probation, community service and a fine.

If the ADA is a really hard nose, it may be 6 months incarceration, probation and a fine.

Just a guess.

Drugs in Kentucky? Certain parts of this bible-thumping place don't even sell alcohol. He's lucky if he doesn't get the chair.
