Here was my schedule:
Sun: 5 hours
Mon: 8 hours
Tues: 9.2 hours
Wed: 8 hours
Thurs: 8 hours
Fri: 6 hours

So, I should have 5.4 total hours overtime, right? 1.2 hours from working over 8 hours on Tues. and another 4.2 hours for working beyond the 40 hours in a week, right? Before I started work on Friday, I had already worked 38.2 hours that week (1.2 of those hours was overtime), so after 1.8 hours on friday the remainder should be overtime, right? My employer wants to only give me 4.2 hours overtime.

In CA, the law states that overtime is paid for hours over 8 in DAY and over 40 in a week, for those of you who didn't know.

Your employer is right it is only 4.2. I know it sucks but you have to go over the 40 hour mark in a week to start racking up those OT hours.

If the work week begins on Sunday then you worked 44.2 hours for the week. Which is 4.2 hours overtime.

It does not matter when you put in the overtime. It only acrues (builds up) after the 40 hours a week.

If OT was anything over 8 hours, then you should actually be docked on the days you didn't work 8 hours.

You can't count something as overtime and hope it adds up to your total hours for the week for regular time as well.

It all depends on the company. Some give overtime after 8 hrs.
but all have to pay over 40. You can't get double overtime because you worked 9 hours in one day.

It depends on what the policy is for calculating overtime. I don't think there is one set way to do it. Some companies consider anything over 8 hours in a day to be OT, others don't consider it overtime until it's over 40 hrs in a week. Where I used to work, it was anything over 8 hrs/day, where my husband works, it's anything over 40 hrs/week. Check with your employer on the OT policy.

Incorrect. Most companies, you are only paid overtime for the hours beyond 40 hours that you work. You would have to check with the rules at your company, which would be in a handbook or such.

I think they would do time and a half for overtime: for example lets say you make 10.00 an hour time and a half would be 15.00 an hour. Thats how my overtime was calculated in Florida

anything over 40 hours in a 7 day/40 hour pay period is OT (time and a half).......if your company pay period runs from SUN-SAT you have 4.2 hours of OT.......sorry, your employer is right here

Was friday your day off? what's your regular schedule? how many hours per day?
based on that, CA allows you to claim OT on anything over 40 hrs. and anything over 8hr. per day
