The seller has their own agent and I have one to represent one. She told me, after talking with their agent, that he would split his comission only if we agreed to pay the original asking price?? I'm confused.. Does that mean I have to pay for the realtor's commission that we are using? I thought seller's did that? Please help.

Sorry for the confusion...."she" is my agent, "he" is their agent...he's the one that will only split if we pay the asking price... Anything I can do?

He's representing them, but the listing DOES NOT have an MLS #

I agree with Satamag, dump this real estate agent. She is not in your corner. You should tell her that you want to make an offer on the house and stay firm, if she does not want to present the offer as is then you should find someone that will. You might also tell her you want to be there when the offer is presented to the owner, that is a right you have. If she refuses get another agent.

I really dislike agents like her, she gives the real estate industry a bad name. She knows better.

Well, whatever you pay for the house, the commission comes out of those proceeds, so in effect you do pay them. If two agents work to sell a home, they have to split the commission, unless you have contracted your agent at a set fee. Of course the agents want to get you to pay the most they can for the house, because that's what the commission is calculated on. You need to stick to your guns so to speak and not pay more then you think the house is worth. In the end, it should be the owner of the home making the decision to accept or reject the offer on their home, not the agents.

The agent that is working with the Seller's is in violation! If he put in the MLS that he is willing to splut the commission, he has to split it no matter what the price is!

dump him. He's saying that he will split his commission, that he gets from the seller, only if you pay full asking price. In other words, he doesn't want to negotiate for a better deal nor is he looking out for your best interest.

Find someone who is willing to split thier commission and is willing to look out for you as well.
