My brother's kids were taken because of abuse and my mom and dad want to gain custody , but Florida says they have no rights? What should they do? Other than hire a lawyer? They are in Cincinnati,and the children are in Daytona Beach, Fl.The children have been in foster care for 18 months now.If you need more details...please ask.

Depending on prior circumstances -- they have to give the parents ample time to get themselves back on track (counseling, parenting classes, anger management, etc.). Maybe the parents will allow custody to be transferred if they really don't want to care for the child. Either way the grandparents should gain as much info from the foster care agency on the processes they follow and give them their vitals in case the kids need anything. See how things go and then seek legal counsel on custody if that is feasible.

if your the biological grandparents you have rights under florida law there is a couple websites you can check gooluck!
