I am not comfortable with her taking them out of the country for a "trip", especially since it is to her country of origin.

Permission is definitely needed, and sometimes the ex cannot even get to the airport gate without a written note from the other parent allowing the kids to go.

I'd suggest checking out your yellow pages and look for a family atty offering a free 1/2 hour consultation and go see him/her so you'll know the exact rules. My guess is she can take them on a vacation, which I'm sure you'd say ok to, but if she's actually bolting with the kids to another country for good, you need to know your legal options.

With Joint custody, she your permission to take them over a state line. Check your divorce papers for clauses about traveling.

Have your attorney right up the stipulations of the trip. i.e, how long they are to be gone, where will they be, etc. If you don't want them leaving the country then do not let them obtain a passport. Both parents have to be present, or a signed affidavit has to be submitted. If you are uncertain about the intent, don't let them go.

ABSOLUTELY. and if his original heritige is out of this country I wouldn't let your children out of your sight! (Islam (sp?) for instance are very disceptive people...they do anything for their version of their god..(small g) but, a lot depends on the current relationship you have w/ your ex-spouse too. Do you trust him? After all you were married to him...who knows him better than you do? Best advice? Pray about it! God knows the beginning from the end!

yes of course she needs your permission. and i would say HELL NO. there is no way i'd allow anyone to take my child out of the country, you would have one hell of a time trying to get them back if she didnt. i'd really think twice about that if i was you.
