my husband and i had an argument, it was nothing more than that and now they are trying to say that we laid hands on each other. and plus thats all they heard was a yelling match. do i have to wait til after court on the 7th of july to obtain my police report?

if it helps i live in kansas and my husband is in the military and just got back from iraq and i think this is just a bunch of bull because we would never touch each other and i am curious to know what the arresting officer wrote in it, because she was being so rude to me and wouldnt help me in the middle of a major asthma attack, so i gave her hell. i respected her until she refused to help me, so i think she might try to pin things on me thats not true. im just worried. anyone know the law on it?

the military offers free lawyers so thats what we are going to get. also i want to add that me or my husband pressed charges on each other and i do believe that the arresting officer is the one that pressed the charges, which is wrong on her part because all she heard was arguing

that last part was an accidental typo, what i meant was that me and my husband DIDNT press charges on each other, the officer did

FOR EVERYONES INFO, WE DIDNT CALL THE POLICE, NOONE EVER LIED AND NOONE WAS EVER HIT. I JUST FOUND OUT THAT IN KANSAS, IF THERE IS PROBABLE CAUSE LIKE HEARING YELLING, THEY HAVE TO TAKE YOU IN FOR BATTERY, SO WHITEY, YOU THINK UR A COP? WHATEVER. some of you are just dimwitted people, this so called whitney who thinks hes a cop dont know crap. "how can you give someone hell during an asthma attack" obviously, what i meant (i guess i have to spell if out for some of you) is that afterwards i showed her no respect, because she didnt deserve respect. i dont give a damn if she is god. i will not be treated like that and for all you other big-headed cops out there, SUCK A DICK

In California, our department policy states that only the victim in the DV case is entitled to a copy of the report through the records department. The suspect is only granted a copy of the report when we've received a subpoena for it (usually through the suspect's attorney).

The district attorney's office already has the report and the defense is able to get that through motions of discovery.

Technically, through the Freedom of Information Act, anybody may request a copy of any report from a government agency. In many cases though, the reports given have had so much information redacted/deleted due to privacy rights, that they end up containing little to no usable data.

How can you give someone hell during a major asthma attack? As a former police officer, now attorney, I HATED going to domestic disputes...usually, the female would call the police for help. Once the officers arrived the female would demand that something be done. If she had been hit we would take him to jail for domestic battery. Sometimes the female would be happy with us, mad at us, violent with us.

The next day her story would change. She never called (even though we had her telephone call recorded), she never wanted us there, we lied, she was never hit, never said she was hit...but, the minute you don't take him to jail she would file a complaint.

The next week we would go back to the same house, and deal with the same people...over and over again...

Why would the police lie about the assault? Do you think they enjoy filing ignorant reports, or dealing with ignorant people? Did they just show up at your house for a tea party? Please, they have better things to do...next time, don't call!

No! You can pick one up to take to court with you. The police might charge you a few dollars. You have to fill out one of their forms also. That report is considered evidence in your case whereyou want to contest the contents.

well me and my hubby was in the same situation......unfortunately you cannot get any info on the report.....and you will not be able to drop any charges against one/ another....the state will pick up the charge immediatley...we had to hire a lawer to get things cleared up.......but again it still lies against HIM......

no you can get a copy, your lawyer will also have one (if you have one yet) you just need to go the place where you can get them.

I would think that they would have to provide it during discovery.
